I hear you but "Foundational Black American" has no legal standing. I like the definition they came up with in California "Descendants of Enslaved Africans whose families were in the USA prior to the 1900s". It's very specific and stops other Black and non-Black groups from shoehorning themselves into the claim.
Legal Standing isn't hard to establish (1) an injury in fact, (2) causation, (3) and redressability "Foundational Black American" covers all of that but we don't have to argue over semantics both terms will work it's just a matter of getting the other wording correct.
